Enhancing Governance in Vietnam’s E-commerce and Digital Business

In a decisive move to bolster oversight and efficiency in Vietnam’s realm of e-commerce and digital business, Prime Minister Pham Minh Chinh has issued Official Dispatch No.56/CD-TTg. This directive signals a renewed commitment to enhancing state management practices across these rapidly evolving sectors, underscoring Vietnam’s proactive stance in digital economy governance.

The official dispatch mandates comprehensive actions across key ministries and agencies, aiming to streamline regulatory frameworks, enhance operational transparency, and fortify security measures. Key directives were outlined for each responsible ministry:

Under the directive, the Ministry of Industry and Trade assumes a pivotal role in reviewing and refining existing legal frameworks governing e-commerce. This includes proposing timely amendments and enhancements to existing policies, ensuring they are adaptive to the dynamic landscape of digital commerce. Emphasis is placed on fostering an environment conducive to business growth while safeguarding consumer rights and market integrity.

Collaborating closely with relevant stakeholders, the Ministry of Finance is tasked with simplifying administrative procedures to facilitate smoother transactions for taxpayers engaged in e-commerce activities. Efforts also focus on optimising customs clearance processes for goods traded via digital platforms, aiming to bolster tax compliance and mitigate risks associated with tax evasion and customs violations.

To strengthen cybersecurity and combat digital fraud, the Ministry of Public Security spearheads initiatives to integrate the national population database with various governmental databases and information systems. This integration enhances electronic identification and authentication capabilities, enabling more robust measures against fraud and tax evasion within the e-commerce sector.

In tandem with other ministries, the Ministry of Information and Communications is charged with developing technological solutions to monitor and regulate digital transactions effectively. These efforts target curbing commercial fraud, counterfeit goods, and violations of intellectual property rights, thereby safeguarding consumer interests and maintaining market fairness.

Ensuring the reliability and security of electronic payment systems is paramount, as outlined by the State Bank of Vietnam. The bank oversees the supervision of electronic payment transactions, enhancing the operational efficiency of interbank payment systems crucial for supporting e-commerce activities. Additionally, it mandates financial institutions and payment intermediaries to comply with regulations concerning income generated from cross-border digital platforms.

Recognising the critical role of cybersecurity in national sovereignty protection, the Ministry of Defence intensifies efforts to combat high-tech crimes and safeguard national cyber infrastructure. Close collaboration with other ministries is emphasised to prevent smuggling and trade fraud, reinforcing Vietnam’s cybersecurity posture amidst the growing digital economy landscape.

At the regional level, provincial and municipal authorities are urged to align with national directives, ensuring seamless coordination and effective deployment of e-commerce development strategies. This includes adhering to previously issued governmental decisions and directives aimed at fostering connectivity, data sharing, and enhanced tax management in digital commerce.

OpenGov Asia reported that Prime Minister Pham Minh Chinh earlier highlighted the crucial implementation of Project 06, focusing on advancing Vietnam’s digital transformation agenda through resident data development and electronic identification systems. The initiative has streamlined administrative procedures, enhanced data connectivity, and popularised the VNeID e-identification app, contributing to significant savings and improved public service accessibility.

He stressed the need for further regulatory reforms to support data sharing and administrative efficiency, alongside recent advancements in data security compliance demonstrated by a new platform launched in Hanoi.

By fortifying regulatory frameworks and enhancing collaborative efforts across ministries, Vietnam aims to not only stimulate economic growth through digital commerce but also safeguard national interests and maintain market stability.

With these proactive measures, Vietnam stands poised to capitalise on the opportunities presented by the digital economy while effectively managing associated risks, ensuring sustainable development in the digital era.
